LDP Stages

The stages of the LDP process are set out below in time order. Documents relevant to each stage can be found by clicking on the relevant stage. The latest stage is the 2017 Schedule of Matters Arising Changes, which is being carried out during the LDP’s Examination in Public (see Examination Webpage).

Back in 2011 the Council invited landowners, developers and others to suggest potential sites for development over the Plan period. This was done to help gather evidence on land availability.

All potential sites submitted during the Call for Sites stage are called ‘Candidate Sites’ and have been recorded on a ‘Candidate Sites Register’ which can be found following the link below.

 

The sites published in the Register are not necessarily supported by the Council.  Please refer to the ‘Site Status Report’ and the ‘Allocations’ in the revised Draft Deposit LDP (2015) to see which sites have been taken forward.

Powys County Council consulted on its LDP Preferred Strategy back in March / April 2012.  This was a way of setting out the Council’s Preferred Strategy for the development and use of land in Powys in the early stages of the Powys LDP’s preparation.

The strategy served to identify a vision and objectives for the LDP based on an understanding of the characteristics, issues and needs of the County and the communities it supports.  Another purpose of the Preferred Strategy was to consider initial options for how much land the LDP should allocate for dwellings, employment and retail and which settlements would be best suited to accommodate this growth.

LDP Preferred Strategy March 2012 

The Deposit Draft LDP (2014) was published for public consultation from the 28th July to the 8th September 2014 and 670 comments or representations were received in response to the consultation.

The representations that were received on the Deposit LDP, 2014 can be viewed on-line through the reference points in each of the consultation documents on this page.

The representation received from Welsh Government advised the Council that further supporting evidence should have been available to support the LDP at the time of the deposit consultation. Without this in place, Welsh Government advised that there may be a risk that the LDP might be found unsound at examination or additional work would be required at that point.

Having discussed and considered Welsh Government’s comments, the Council has decided to repeat the consultation please click on the link below labelled revised Deposit Draft LDP (2015).

FAQs on the MACs consultation

1.       What are Matters Arising Changes?

The Matters Arising Changes (MACs) are changes proposed to the LDP for public consultation purposes. They have arisen from the hearing sessions conducted by an Inspector from the Planning Inspectorate appointed to examine the soundness of the LDP.

Changes are proposed to the policies and text of the LDP (the written statement) and to the proposals and inset maps. Comments can only be made on the proposed changes which are set out in the Schedule of Matters Arising Changes and cannot be made to parts of the LDP that remain unchanged.

The purpose of the consultation is to provide comments on the MACs which will enable the Inspector to determine whether the changes are appropriate.

2.       Where can I read the background and supporting evidence?

As well as reading the Schedule of MACs it is also important to understand the reasons for each of the proposed changes to inform any comments that you may wish to make.

The Examination Library includes all of the supporting evidence for the MACs. The library is available on the LDP website or a paper library is held in the Gwalia, Llandrindod Wells.

The MACs have been proposed as a result of the Examination’s hearing sessions held between March and July 2017. During each session, action points (AP) were identified and some of these included actions to amend parts of the LDP. All of the APs and responses to the actions have been published in the Examination Library (as Examination Document ED039 or on the Hearings page of the Examination website).

To help understand the reasons for the proposed MACs, these should be read alongside the relevant APs and agreed responses.

How do I make comments?

Please use the representation form, which is provided on the LDP website, because it has been designed to gather all necessary information. The return address (for email or post submissions) is provided on the form. Returning the form by email is preferable.

Comments must either support or object to the proposed changes. If objecting, you should explain your reasons.

5.       What is the deadline for making comments?

The deadline is 5pm on the 30th October 2017. Any comments received after the deadline will not be accepted.

6.       What will happen to my comments?

All comments will be acknowledged by the Council.

After the consultation period closes, the Council will collate and forward a paper set of all the comments to the Planning Inspector. The Planning Inspector will read the comments and the matters and issues they raise to decide whether it is necessary to hold further hearings. If further hearing sessions are held, the LDP Programme Officer will contact the relevant participants; the LDP Examination webpage will be kept up to date and should be checked regularly.

A paper set of all the comments will be placed in the Examination library in the Gwalia, Llandrindod Wells, which can be viewed by appointment with the LDP Programme Officer.

The Council will update and publish the LDP Consultation Report to describe the main issues arising from the consultation.

7.       What happens after any further hearing sessions?

 

Whether or not further hearing sessions are held, the Planning Inspector will prepare an Inspector’s Report which will be submitted to the Council. Whilst writing the report, the Examination remains open and the Inspector could request additional evidence. When completed, the Inspector’s Report will be submitted to the Council and any recommendations within it will be binding upon the Council. A meeting of Powys County Council will be held to adopt (approve) the LDP and then it will be used as the development plan for determining planning applications.
